Urban Local Government

Corporation, Council, Panchayat & The 12th Schedule Dynamics

PART I — URBAN TYPOLOGY

ARTICLE 243Q

Types of Municipalities

  • The 74th Amendment standardizes three types of Urban Local Bodies (ULBs) based on population and economic character:
  • **Nagar Panchayat:** For a "transitional area" (an area transforming from rural to urban).
  • **Municipal Council:** For a smaller urban area.
  • **Municipal Corporation:** For a larger urban metropolis. Created by acts of state legislatures (or Parliament in UTs).
ADMINISTRATION

Wards & Executives

  • Cities are divided into territorial constituencies known as **Wards**. Members (Councillors) are elected directly by the people.
  • **Ward Committees** are mandatory for municipalities with a population of over 3 lakhs to ensure closer citizen participation.
  • **The Executive Divide:** The *Mayor* is the political head (often ceremonial), while the *Municipal Commissioner* (usually an IAS officer) is the administrative head who holds the real executive power.

PART II — PLANNING & FINANCE

THE 12TH SCHEDULE

Urban Planning & DPC

DPC / MPC
  • The **12th Schedule** lists 18 functional items for ULBs, including urban planning, regulation of land use, water supply, public health, and fire services.
  • **District Planning Committee (DPC):** Mandated to consolidate the plans prepared by both Panchayats and Municipalities in the district into a draft development plan.
  • **Metropolitan Planning Committee (MPC):** Required for metropolitan areas (population of 10 lakhs or more) to coordinate planning across multiple municipalities and panchayats within the metro zone.
FISCAL AUTONOMY

Municipal Revenue

  • Urban bodies require immense funds for infrastructure, but often face acute financial starvation. Sources of revenue include:
  • **Tax Revenue:** Property tax (the major source), professional tax, and tolls.
  • **Non-Tax Revenue:** User charges for water/sanitation, building permission fees.
  • **State Transfers:** Grants-in-aid and shared taxes as recommended by the State Finance Commission.
