Rural Local Governance

The 73rd Amendment, Devolution & The Role of the Gram Sabha

PART I — DEVOLUTION & THE FOUNDATION

ARTICLE 243G

Mandate & Devolution

  • The 73rd Amendment directed State Legislatures to endow Panchayats with the powers necessary to function as **institutions of self-government**.
  • This is based on the principle of **Subsidiarity**—what can be done best at a lower level should not be centralized.
  • **The 3 Fs:** Effective devolution requires the transfer of **Funds** (financial resources), **Functions** (subjects from the 11th Schedule), and **Functionaries** (staff/personnel) from the state down to the Panchayats.

The Gram Sabha

  • The Gram Sabha is the bedrock of democratic decentralisation. It comprises all registered voters within the area of the Gram Panchayat.
  • **Direct Democracy:** It is the *only* platform of direct democracy in the Indian political system. It acts as the legislature of the village.
  • **Role:** It reviews the annual statement of accounts, audits reports, identifies beneficiaries for anti-poverty programs, and holds the elected Gram Panchayat executive accountable.

PART II — EQUITY & EMPOWERMENT

Reservations & Equity

1/3
  • The Constitution mandates the reservation of seats for Scheduled Castes (SCs) and Scheduled Tribes (STs) in proportion to their population in the Panchayat area.
  • **Women's Empowerment:** Crucially, a minimum of **one-third (33%)** of total seats and Chairperson offices at all three tiers must be reserved for women.
  • *Progress:* Several states (including Bihar, Madhya Pradesh, Kerala) have proactively increased this reservation for women to **50%**, fundamentally altering rural political dynamics.

State Finance Commission

  • The Governor constitutes a State Finance Commission (SFC) every five years to review the financial position of the Panchayats.
  • It recommends the principles governing the distribution of net proceeds of state taxes, duties, and tolls between the State and the Panchayats.
  • It also recommends grants-in-aid to the Panchayats from the Consolidated Fund of the State, ensuring they have the fiscal autonomy required to execute their functions.
