26 OCT 1947 INSTRUMENT OF ACCESSION
WORLD A · REALM 05 ONTOLOGY

Jammu & Kashmir

Accession Context (1947) · Constitutional Position (Art 370) · Territorial Conflict

The Northern Crown of the Republic (1947–Present)

Encompassing 84,471 square miles across Jammu, the Kashmir Valley, Ladakh, and Gilgit-Baltistan, the princely state of Jammu & Kashmir faced an existential invasion on October 22, 1947 when Pakistan-backed tribal lashkars launched *Operation Gulmarg*. Maharaja Hari Singh's execution of the **Instrument of Accession on October 26, 1947**, backed by Sheikh Abdullah's National Conference and the dawn airlift of Indian troops, legally and irrevocably bound J&K to the Union of India—initiating a multi-decade narrative of high-altitude military defense, UN diplomacy, and constitutional evolution under **Article 370**.

SUB-WORLD IV — GEOPOLITICAL FRONTIERS & SYNTHESIS ATLAS

MICRO-REALMS 05.32 – 05.36

Core Distinctions (High-Yield)

Instrument of Accession (26 Oct 1947) vs. Mountbatten's Cover Letter (27 Oct 1947)

The Instrument of Accession signed by Maharaja Hari Singh on Oct 26, 1947 was completely unconditional and identical in legal form to the document signed by all other 562 princely states. Mountbatten's expression of a "reference to the people" was in a separate diplomatic cover letter and was conditional on the complete restoration of law and order and withdrawal of invaders.

UNCIP Resolution 47 (Aug 1948): Sequential vs. Simultaneous Obligations

Under UNCIP Resolution 47, obligations were strictly sequential: Part II Step 1 required Pakistan to withdraw all tribesmen, Pakistani nationals, and regular troops from J&K first. Because Pakistan never vacated PoK and Gilgit-Baltistan, Part III (plebiscite) could legally never be triggered.

1949 Ceasefire Line (CFL) vs. 1972 Line of Control (LoC)

The 1949 Ceasefire Line was demarcated under the UN-brokered Karachi Agreement; the 1972 Line of Control (LoC) was established under the bilateral Simla Agreement (after the 1971 War), converting the truce line into a bilaterally managed line and rendering third-party UN mediation obsolete.

Ontological Progression

Having completed the integration of the British Indian provinces and the 565 princely states (including Junagarh, Hyderabad, and Jammu & Kashmir), World A turns to the remaining European colonial enclaves on Indian soil: the **French and Portuguese Territories**.
