Judicial Activism
Creativity, The Vacuum, Overreach & Restraint
PART I — PROACTIVE JUSTICE
THE DYNAMIC ROLE
Judicial Creativity & PIL
- **Judicial Activism** refers to the proactive role played by the judiciary in protecting citizen rights and promoting social justice.
- It departs from strict adherence to legal precedents, interpreting the Constitution creatively to meet modern societal needs.
- **PIL (Public Interest Litigation)** is the most potent weapon of judicial activism, allowing the court to act on behalf of the marginalized.
THE CATALYST
Filling the Vacuum
- Why does activism happen? Primarily due to the **failure of the Executive and Legislature** to discharge their duties effectively.
- When the elected branches leave a "vacuum" through inaction, corruption, or apathy, citizens turn to the courts as the last resort.
- To prevent the collapse of the democratic structure, the judiciary steps in to fill this vacuum.
PART II — THE THIN RED LINE
CROSSING BOUNDARIES
Judicial Overreach
- When judicial activism crosses its limits and becomes judicial adventurism, it is termed **Judicial Overreach**.
- It occurs when the court encroaches upon the domain of the Executive or Legislature, violating the **Separation of Powers**.
- *Examples often cited:* The SC cancelling 122 2G spectrum licenses en masse, or banning the sale of liquor along national highways (which is arguably an executive policy matter).
THE ANTIDOTE
Judicial Restraint
- The antithesis of activism. A philosophy asserting that judges should **interpret the law, not make it**.
- Courts should show deference to the elected branches (Executive and Legislature) as they represent the will of the people.
- Judges should not substitute their own policy preferences for those of the elected government unless a law explicitly violates the Constitution.
