Functions of VP
Chairman of Rajya Sabha & Acting President
PART I — THE PRIMARY ROLE
ARTICLE 64
Ex-Officio Chairman
- The Vice-President is the *ex-officio* (by virtue of office) Chairman of the Rajya Sabha.
- This is their normal, day-to-day constitutional function.
- Modeled entirely on the American Vice-President, who acts as the President of the US Senate.
VOTING POWERS
The Casting Vote
- Because the VP is **not a member** of the Rajya Sabha, they cannot vote in the first instance on any bill or motion.
- They can only exercise a **Casting Vote** in the case of a strict tie, to resolve a legislative deadlock.
- They manage the House, maintain order, and protect the privileges of members.
PART II — THE CONTINGENCY ROLE
ARTICLE 65
Acting President
- Steps in as Acting President during a vacancy caused by death, resignation, or removal (for a maximum of **6 months**).
- Also discharges the functions of the President when they are unable to act due to absence or illness.
- Does NOT assume the Presidency for the remainder of the unexpired term (unlike the US system).
SEPARATION OF DUTIES
Shift in Functions
- While acting as President, the VP **does not** perform the duties of the Chairman of the Rajya Sabha.
- During this period, RS duties are performed by the Deputy Chairman of the Rajya Sabha.
- The VP ceases to draw the salary of the Chairman and instead draws the salary and allowances of the President.
